I belive that Volokh has commented on this subject long ago: THe FCC could do little to nothing to Fox News, because it’s a news story, and the FCC cannot dictate content to a news show. The difference is that the Super Bowl was a regulare Prime-Time show, not a news program.

BTW, since it was a unanimous vote, does it matter that the certain democrat wasn’t there? If he was there, Frist would have just delayed the vote until Kerry left to get some coffee. Then the hypocr… I mean the republicans would have voted real quick and then whined about Kerry missing another vote.

The biggest irony here (aside from Fox showing penetration, -snicker-) is that all the rabid frothing anti-FCC types don’t realize that it’s a Democrat, let me repeat myself, a DEMOCRAT fining the hell out of every “indecent” body.
Sheesh.
What really irritates me is that the Senate recently voted unanimously (minus the vote of a certain Democrat who, somehow, couldn’t be bothered to be present) to increase FCC fines.
I sure wish this country was still about freedom.
