Nipple Fine Overturned?
Remember Janet Jackson’s nipple?
How could you forget?
The FCC’s $550,000 fine for the half-second nippleshow made headlines back in 2004, and has had network TV busily bowdlerizing ever since. Only guess what? The fine has been overturned:
A panel of the 3rd U.S. Circuit Court of Appeals ruled Monday that the FCC “acted arbitrarily and capriciously” in issuing the fine for the fleeting image of nudity.

The court said the FCC deviated from its nearly 30-year practice of fining indecent broadcast programming only when it was so “pervasive as to amount to ‘shock treatment’ for the audience.”

Does anyone know anyone who was actually HARMED by the incident? (I mean other than possibly some superstitious guy at the FCC…) If so, I’m curious as to what form the harm took? Anyone… Bueller… Bueller…
I’ve gotta love that my hometown hosted the raunchiest superbowl forever. So much mad open revelry that the light rail couldn’t run, They brought busses in later to take home the weary busboys and bartenders once the bars closed, and ran a couple of trais after 2;30 even though the train shuts wown at two.
And the nip slip was no big deal compared to the hip-thrusting dancers during Nelly’s rap. And Janet Jackson bought local. A Houston costume designer made the cutaway cups and a local jeweler made the nipple shield.
Had it been Britney Spears who did that dance routine with “accidental” nip slip included, would the reaction have been different? Unfortunately, I think it would have been.
