By the letter of the law, no, but I don’t think that law gets invoked when the stars and stripes get draped across pretty ladies (or handsome gents, in parts of the USA where that’s smiled upon).
Nahh….just not for “commercial purposes”. When I swam (eons ago) our team had Stars and Stripes ?? print suits. Nobody gave them a second thought.

You are correct that nobody cares any more, and I don’t either. But that’s what I was referencing with my “not supposed to” throwaway line.
